Welcome to Hydrate! These Terms of Service ("Terms") govern your use of the Hydrate mobile application ("App") and related services. By downloading, installing, or using Hydrate, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Hydrate, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Eligibility
You must be at least 13 years old to use Hydrate. By using the App, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You will use the App in compliance with all applicable laws
3. License to Use the App
3.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on devices you own or control
- Use the App for your personal, non-commercial purposes
3.2 Restrictions
You agree NOT to:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Distribute, sell, lease, or sublicense the App
- Use the App for any illegal or unauthorized purpose
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App to harass, abuse, or harm others
- Attempt to gain unauthorized access to the App or its systems
4. User Accounts and Data
4.1 Account Security
You are responsible for:
- Maintaining the security of your device and account
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4.2 User-Generated Content
You retain ownership of the water intake data and information you log in the App. By using the App, you grant us a license to use this data to provide and improve our services, as described in our Privacy Policy.
5. Subscriptions and Payments
5.1 Free and Premium Features
Hydrate offers both free and premium subscription features:
- Free: Basic water tracking, 7-day history, up to 3 reminders/day
- Premium: Advanced features including 30-day history, unlimited reminders, custom drink types, and more
5.2 Subscription Plans
Premium subscriptions are available as:
- Monthly: $0.99 per month, auto-renewing
- Annual: $4.99 per year, auto-renewing
- Lifetime: $14.99 one-time payment, non-renewing
5.3 Auto-Renewal
Monthly and Annual subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
5.4 Managing Subscriptions
You can manage and cancel subscriptions through your Apple App Store account settings:
- Open your iPhone Settings
- Tap your name at the top
- Tap "Subscriptions"
- Select "Hydrate"
- Tap "Cancel Subscription"
5.5 Refunds
All purchases are processed through the Apple App Store and are subject to Apple's refund policies. We do not directly process refunds. To request a refund:
Refunds are granted at Apple's sole discretion. Generally, refunds are not provided for:
- Partial subscription periods
- Unused portions of subscriptions
- Change of mind after purchase
5.6 Free Trials
If you sign up for a free trial:
- You will not be charged during the trial period
- You can cancel anytime during the trial without charge
- If you don't cancel, you'll be automatically charged when the trial ends
- Only one free trial per user
5.7 Price Changes
We may change subscription prices at any time. Price changes will:
- Be communicated to you in advance
- Not affect your current subscription period
- Take effect at your next renewal
- Allow you to cancel before the increase takes effect
6. Health and Medical Disclaimer

Hydrate is NOT medical advice and is not a substitute for professional medical consultation.
- The App provides general hydration tracking and recommendations
- Individual hydration needs vary based on health, activity, climate, and other factors
- Always consult a healthcare professional for medical advice
- Do not rely solely on the App for health decisions
- If you have medical conditions affecting fluid intake, consult your doctor before changing hydration habits
7. Weekly Leagues and Competitions
7.1 League Participation
By participating in weekly leagues, you agree that:
- Your water intake totals may be visible to other users
- Your display name or username will be shown on leaderboards
- Rankings are based on self-reported data and may not be verified
- We reserve the right to remove users who manipulate or falsify data
7.2 Fair Play
You agree NOT to:
- Falsify water intake data to gain competitive advantage
- Use automated tools or scripts to log water
- Create multiple accounts to participate in leagues
- Harass or abuse other league participants
8. Intellectual Property
All content in the App, including but not limited to:
- Text, graphics, logos, icons, images
- Software code and functionality
- Design, layout, and user interface
- Trademarks and service marks
...are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
9. Third-Party Services
The App may integrate with third-party services:
- Apple App Store: Payment processing and distribution
- Apple Health: (Future feature) Health data sync
Use of these services is subject to their respective terms and policies. We are not responsible for third-party services.
10. Termination
10.1 By You
You may stop using the App at any time by:
- Deleting the App from your device
- Canceling any active subscriptions
- Requesting account deletion in Settings
10.2 By Us
We may terminate or suspend your access immediately, without notice, if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Abuse or harass other users
- Attempt to harm or exploit the App
11. Disclaimers and Limitations of Liability
11.1 No Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability or fitness for a particular purpose
- Accuracy, reliability, or completeness of content
- Uninterrupted or error-free operation
- Security or freedom from viruses
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Service interruptions or data loss
- Any damages arising from your use of the App
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS LESS.
12. Indemnification
You agree to indemnify and hold harmless Hydrate, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of others
- Your user-generated content
13. Changes to Terms
We may modify these Terms at any time. When we do:
- We will update the "Last Updated" date at the top
- We will notify you through the App or via email
- Continued use after changes constitutes acceptance
- If you disagree with changes, stop using the App and cancel subscriptions
14. Governing Law and Disputes
14.1 Governing Law
These Terms are governed by the laws of [Your Country/State], without regard to conflict of law principles.
14.2 Dispute Resolution
Any disputes arising from these Terms or the App shall be resolved through:
- Good faith negotiation between parties
- Binding arbitration if negotiation fails
- Small claims court for eligible disputes
15. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hydrate.
15.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
15.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
15.4 Assignment
You may not assign these Terms. We may assign them without restriction.
15.5 Apple-Specific Terms
Regarding apps distributed through the Apple App Store:
- These Terms are between you and Hydrate, not Apple
- Apple has no obligation to provide support or maintenance
- Apple is not responsible for the App or its content
- You represent that you are not in a country subject to U.S. embargo
- Apple and its subsidiaries are third-party beneficiaries of these Terms
